Acceptable Use Policy (AUP)

Alteron preserve the value of the Internet as a resource for information and free expression and respect the privacy and security of Internet users, but strongly discourages irresponsible practices, which degrade the usability of network resources and thus the value of Internet services.

Background

This Acceptable Use Policy (AUP) is an agreement ("Agreement") between Customer and Alteron. PLEASE READ THIS DOCUMENT CAREFULLY and retain it for future reference. Please note that the information contained herein is subject to change without notice. Customer agrees to periodically consult this website for changes or amendments to this Agreement. ALteron may, but is under no obligation to, provide notices of any amendment, modification or update of this Agreement via e-mail to Customers. BY REGISTERING FOR AND USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT AS WELL AS ALL POLICIES AND GUIDELINES OF THE AUP, WHICH ARE INCORPORATED HEREIN BY REFERENCE.

Unacceptable Content/Activities/Programs

Cancellations of services may be caused by abuse. Examples of unacceptable Content/Activities/Programs are, but not limited to:

• Spam, all forms of Email Abuse and Bulk Email related products - Customer shall not transmit or disseminate unsolicited commercial e-mail (UCE), or unsolicited bulk messages (Spam). Confirmed Opt-In (also known as Double Opt-in), is the only method we allow for the use of e-mail lists
• Background running programs (bots/daemons/monitors) - Unauthorized monitoring of data or traffic on any network or system without express authorization
• IP range scanning/port scanning/vulnerability scanning - Unauthorized access to or use of data, systems or networks, including any attempt to scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization
• The placement of extremist material or material not deemed in good taste is not permitted - Customer is held fully responsible for any misuse of account regardless of whoever published the content
• Distributed Denial of Service (DDoS) - No ALteron resources and servers may be used to perform any form of DoS attacks. If a server is being attacked by any form of DoS, the server will be suspended for 48 hours. If the attack continues, Alteron will null-route, ACL or otherwise suspend the services in its entirety to maintain quality of service for other Customers on our network unless anti DDoS mitigation service is subscribed

Network Performance

Alteron provides shared network resources and, therefore, excessive use or abuse of these resources by one client is a violation of this AUP.

Use of Services

Customer Security Obligation: Each Customer must use reasonable care in keeping each VPS account or dedicated server and/or network devices attached to Alteron infrastructure up-to-date and patched with the latest security updates. Failure to use reasonable care to protect a server may result in a security compromise by outside sources. Alteron is not responsible for Customer server level security unless a security administration package, firewall security administration package or fully managed operating system package is contracted for and maintained. A compromised server creating network interference will result in immediate Customer notification and will be disconnected from the network immediately so as to not directly affect other Customers. No service credits will be issued for outages resulting from disconnection due directly to breached server security. The Customer is solely responsible for any breaches of security affecting servers under Customer control, including repairing the system, terminating the account(s) of the abusive user(s), and reporting occurrence of the issue to Alteron by email.

Bandwidth Usage: Alteron offers offers a set amount of data transfer per VPS server. Bandwidth is calculated on a recurring 30 days. Bandwidth overcharge is priced at 9.00 € per each additional 1 TB. For dedicated servers have no metered package. If the limit is exceeded, the connection of the server will be reduced to 10Mbit/s. For 100Mbps bandwidth will be charged 9.00 € per each additional TB. Customer is solely responsible for monitoring his/her bandwidth usage.

Network Security: Violations of system or network security are strictly prohibited. Alteron investigates all incidents involving such violations and will cooperate with law enforcement if a criminal violation is suspected.

No "Spam", "Spyware", "Virus" or "Adware": We have no tolerance against servers that contain spyware, viruses and adware. Servers that we find in our network or may be abuse of products containing these items will be removed immediately. UCE/UBE or "Spam" is not tolerated. Alteron reserves the right to deactivate or terminate any server(s) upon any indication of such activity without notice. There will be a 60.00 € clean up fee if an account was suspended for policy violation.

Support Services

Alteron provides 24/7 support for Network issues. Managed services are not included in the offers. If needed or desired the user will be charged separately.

Privacy Policy

Alteron respects the privacy of every customer or web site visitor and may collect customer information for processing customer order. The informations will not be shared with any third party.

Refund Policy

All payments made to the Company by You or on Your behalf are nonrefundable - including the one-time set-up fee, if any, as well as any/all subsequent monthly charges (regardless of usage). Overcharges or billing disputes must be reported to the Company within thirty (30) days of occurrence, otherwise You shall waive all claims related thereto. If You dispute a charge to Your credit card issuer, which charge the Company deems, in its sole discretion, to be valid under the terms and conditions of this Agreement, You shall pay the Company, in addition to the said disputed charge, an Administrative Fee of not less than USD 50.00 and not more than USD 150.00. Single Refunds are possible as exceptions to the rule by decision of management.

Right of Refusal

Alteron reserves the right to disable service or terminate service and/or to remove content in order to investigate suspected violations of this AUP. Alteron at its best effort will notify any customers of any violation so that the customer can investigate the case and provide necessary explanation or solution. Failure to respond to email from our abuse department may result in the suspension or termination of services. In some critical cases, Alteron reserves the right to disable or terminate service without first given notice if the violation affects the entire operation. If the explanation or solution is accepted, customer is given a warning and/or incurs an abuse fees. Alteron does not issue refunds for terminating service due to any of the causes specified above.

Alteron reserves the right to refuse service to anyone. Any material that is illegal or violates our terms of service in any manner may be removed or suspended with or without notice.

Disclaimer of Warranty

Alteron is not responsible for any interruption in service or down time that may occur, whether due to external network disruptions. This includes loss of data resulting from delays, non-deliveries, wrong delivery, equipment failure and any and all other service interruptions caused by Alteron.

Suspension and Cancellation

Nonpayment in whole or in part for any of services provided to you by Alteron or violation of the Acceptable Use Policy, may result in the immediate suspension or cancellation of any or all services. Any fees paid in advance are nonrefundable.
The contract is cancellable without giving reasons by both parties at any time during a period of 10 days to the end of the month, but at the earliest on expiry of the minimum contract period stipulated.
